“HURRICANE SANDY”
WHAT CONTRACTORS NEED TO KNOW ABOUT HOME IMPROVEMENTS & RECONSTRUCTION PROJECTS
IN CONNECTION WITH THE STORM DAMAGE
FRIDAY, NOVEMBER 30, 2012
PRESENTED BY: JAMES A. KOZACHEK, ESQUIRE
& JEFFREY K. NEWMAN, ESQUIRE
On October 30, 2012, President Obama declared Atlantic County, Cape May County, Essex County, Hudson County, Middlesex County, Monmouth County, Ocean County and Union County, New Jersey disaster areas in connection with Hurricane Sandy under DR-4086. This entitles people, businesses and municipalities impacted by the storm to relief under Federal Emergency Management Agency (FEMA) programs. Our seminar will discuss these programs and the builder/contractor roles in the programs.
In order to obtain relief under FEMA programs, claimants must have exhausted all their private insurance options. We will discuss those private insurance claims and how they impact a builder/contractor working on a storm-damage repair or restoration project.
In addition, all work performed on storm damage repairs remain subject to New Jersey laws such as the New Jersey Consumer Fraud Act, the New Jersey Contractors Registration Act, New Jersey’s New Home Builder’s Registration and Warranty Act and New Jersey’s Rehabilitation Sub-code, as well as applicable environmental laws (e.g. NJ Spill Compensation and Control Act), among others. These statutes and regulations will be discussed.
