DESCRIPTION:SPEAKER:  Flaster/Greenberg Environmental Law Shareholder Janet S. Kole    PROGRAM TOPIC:  When the Supreme Court decided Kelo v. City of New London\, it stunned advocates of private property rights. The Court held that the state can use the power of eminent domain to take private property for redevelopment even if the redevelopment is not for traditional public uses\, such as roads or highways\, but for purposes of "gentrifying" a run-down or underutilized area. Builders who are lucky enough to be the favored developer for an area taken by eminent domain and builders who are unfortunate enough to have property taken will want to learn how the state courts are handling challenges to takings for redevelopment in the wake of Kelo. A few state courts have invalidated takings based on a loophole left by the Kelo opinion. The seminar will be a Kelo aftermath update.
